1. Introduction
(a) This website (Site) is operated by By Zero Labs (ABN 23238608308) (we, us or our).

2. Use of the Site, Accounts and Orders
(a) By placing an order on the Site, you agree to be bound by these Terms and Conditions (Terms).

(b) To purchase products via the Site, you must be at least 18 years of age and possess a valid credit or debit card.

(c) You may purchase products as a guest or by creating an account.

(d) If you create an account, you are responsible for keeping your login details secure and for ensuring all personal information is accurate and up-to-date. We collect and handle your personal information in accordance with our Privacy Policy and the Australian Privacy Principles under the Privacy Act 1988 (Cth).

(e) When you submit an order, you are offering to buy the selected product(s) at the listed price, including applicable taxes and delivery charges.

(f) Please double-check your order details before confirming. After submission, you’ll receive an order confirmation email with your order summary.

(g) Product availability is not guaranteed. We aim to keep our stock levels and the Site accurate at all times.

(h) Where an item is listed as pre-order only, this will be clearly shown on the product page.

(i) We reserve the right to cancel any order before dispatch, where we deem appropriate. This includes significant delivery delays, stock unavailability, or errors on the Site (e.g., pricing or description errors). If your order is cancelled, we will contact you using the information provided with your order.

3. Products
(a) We’ve taken care to ensure that all descriptions, images and product details on the Site accurately represent our products at the time of publication.

(b) Prices are displayed in the currency noted in the listing. Any applicable taxes will be clearly stated.

(c) All products are sold for personal use only. You must not re-sell any of our products without our written consent. We may cancel orders that appear to breach this condition.

(d) We currently only ship within Australia. We reserve the right to limit sales to any person, geographic region or jurisdiction, at our discretion and on a case-by-case basis.

4. Pricing and Payments
(a) You agree to pay the purchase price for each product ordered, including delivery fees as outlined in our Shipping, Delivery & Returns Policy.

(b) You must not make payments using fraudulent or unlawful means. When using a card, you warrant that you are authorised to do so.

(c) Payment methods may include ShopPay, PayPal, and Google Pay. These are operated by third parties and may have their own terms and conditions.

(d) We do not store credit card information. Payment data is processed securely via our third-party provider.

(e) International customers may be subject to additional customs duties, taxes or charges. These are your responsibility.

(f) Promotional discount codes may be offered occasionally. These must be entered at checkout to apply, and are subject to specific terms set out on the Site.

(g) Terms of competitions or promotional offers will be listed on the Site at the time of promotion.

(1) Neither party is liable for Consequential Loss;
(2) Each party’s liability is reduced proportionately to the extent that the other party contributed to the loss; and
(3) Our aggregate liability for any liability arising from or in connection with the terms will be limited to the price you pay us for the products.

7. General Terms
(a) Dispute Resolution: Before commencing legal action, both parties agree to attempt in good faith to resolve any dispute through discussions and, if necessary, mediation. Mediation costs are shared equally. Nothing prevents a party from seeking urgent injunctive relief.

(b) Notices: Notices must be sent via email or standard post to the contact details provided. Notices are deemed delivered 48 hours after posting or once sent by email.

(c) Force Majeure: Neither party is liable for delay or failure to perform obligations due to events beyond their reasonable control (Force Majeure Event), provided they notify the other party promptly and take reasonable steps to minimise impact.

(d) Feedback and Complaints: We value your feedback. If you have concerns or complaints, please contact us. We will respond within a reasonable time.

(e) Assignment: You may not transfer your rights or obligations under these Terms without our prior written consent.

(f) Amendments: We may update these Terms at any time by publishing them on the Site. The Terms that apply to your order are those in force at the time you placed the order.

(g) Governing Law: These Terms are governed by the laws of New South Wales, Australia. Both parties agree to the exclusive jurisdiction of the courts of New South Wales.

(h) Third-Party Links: Our Site may contain links to third-party websites. We do not endorse or control these websites, and are not responsible for their content. If we receive a benefit from linking to or featuring products (e.g. a commission), this will be clearly disclosed on the Site.

8. Definitions
(a) Consequential Loss includes indirect loss, loss of profit, business, reputation, opportunity, savings, or data—whether foreseeable or not.

(b) Force Majeure Event means any circumstance beyond a party’s control that prevents it from fulfilling its obligations.

(c) Liability means any loss, damage, cost, claim or expense (including those arising under contract, statute, tort or otherwise).
